Terms and Conditions

The following terms and conditions apply to all orders for the purchase of services from First Aid Bespoke Services Ltd.  If you have any questions relating to the terms and conditions you can call us on 07890 534536 – Monday-Friday, 09:00 to 17:00 not including bank holidays or weekends.  These terms and conditions do not affect your statutory rights.

  1. Definitions:

1.1  ‘First Aid Bespoke Services’ is a limited company registered with Companies House.

1.2  ‘Attendee’ means a person who has been booked to attend a course.

1.3  ‘Contract’ means these terms and conditions and the application form completed by the customer and the booking confirmation sent by First Aid Bespoke Services Ltd to the customer.

1.4  ‘Course’ means a first aid course or a similar course organised and run by First Aid Bespoke Services Ltd.

1.5  ‘Services’ means all courses or services delivered by First Aid Bespoke Services Ltd.

1.6  ‘Customer’ means the purchaser of services being either an individual or an organisation and will include the attendee as customer where the context so requires.

‘Group Course’ means a course booked by a company or an organisation, for the benefit of its staff or other members of the organisation, and is held at a location chosen by the organisation either on their own premises or at another location hired at their own expense.

‘Student’ means a person who attends a course.

2. Payment:

2.1  An organisation that books a group course will be issued with an invoice that must be paid in full prior to the start date of the course.

2.2 First Aid Bespoke Services Ltd reserves the right to withhold certificates until payment for services has been cleared.

3. Cancellations and rescheduling:

3.1  First Aid Bespoke Services may cancel a course at any time and will inform the customer as soon as possible.  If this is necessary the customer will be given the opportunity to re-book another course.

3.2  Cancellations and requests for rescheduling by customers can be made by telephone to 07890 534536.

3.3  For group courses customers may substitute an attendee as a replacement for another attendee. There is no need to inform First Aid Bespoke Services of a substitution.

3.4  First Aid Bespoke Services Ltd does not accept responsibility for the expiration of any first aid certificates as a result of any course cancellation.

3.5  Refunds will not be given for any group course cancelled by an organisation and/or the customer with less than 7 days notice. The cost for the group course must be paid in full.

4. Details of course attendees:

4.1 Details of attendees for all group courses must be provided to First Aid Bespoke Services Ltd no later than the start of the course by the organisation booking the course.

4.2 All attendees on certificated courses must provide photographic proof of identification to the trainer at the commencement of the course e.g. Driving license, passport.  First Aid Bespoke Services Ltd are unable to award attendees with a certificate, without proof of identification.

5.  Attendance:

5.1 It is essential that attendees arrive on time and complete the full course, especially where it is a certificated course.  Good time keeping is essential throughout to ensure that attendees meet all of the course requirements and assessment criteria.

5.2  The full cost of the group course will be charged if part or all of the group are absent for all or part of the course.

5.3  It is the organisation’s responsibility to ensure that all attendees attending a group course are informed of the date and times of the course, the relevant aspects of these instructions pertaining to their attendance and all of the course requirements before the date of the course.

5.4  Attendees who are late for any part of the course may be refused access to the course. The full cost of the course will still be charged.

6.  Booking confirmation:

6.1 Organisations will be sent a booking confirmation by email showing the course start and end time and confirming the location of the course.

6.2  If the organisation does not receive a booking confirmation it is the responsibility of the organisation to contact First Aid Bespoke Services for a confirmation to be re-sent.  The contact number for this purpose is 07890 534536.

6.3  If a member or all of the members of a group course booking do not attend the course because the organisation did not receive confirmation of booking, the organisation must still pay the full cost of the group course.

7.  Certification:

7.1 Where a course is certificated, organisations will be sent a copy of the students’ certificates by post to UK addresses.  There will be a small charge if additional certificates are required.

8.  Equal opportunities and attendees needs:

8.1  First Aid Bespoke Services Ltd operates an equal opportunities policy and it is the responsibility of the organisation to notify First Aid Bespoke Services Ltd of any needs or dietary requirements of attendees, to ensure they are treated fairly and they can participate fully in the course.

8.2 First Aid Bespoke Services Ltd is unable to accommodate the use of signers or interpreters on any regulated courses and as such customers must ensure that for all courses their attendees have a sufficient grasp of the English language to meet the assessment criteria, both oral and written.

8.3  On our unregulated courses, attendees are welcome to use signers or interpreters at the organisation’s or the attendee’s own cost.

9.  Age requirements, fitness for the role of first aider and disposition:

9.1 For certificated courses in the workplace, all attendees must be able to provide first aid at work in line with Health and Safety Executive’s (HSE) approved codes of practice.

9.2 All course attendees must be free from any condition that would prevent them completing the course successfully or carrying out the role of first aider in the workplace e.g. attendees must be able to kneel on a hard surface and perform CPR and be able to place a casualty into the recovery position by rolling a casualty onto their side. This condition applies to both certificated and uncertificated workplace courses.

9.3  In all courses, it is the responsibility of the organisation and the student to advise the trainer of any medical issues or injuries that may affect the student’s participation on the course prior to the commencement of the course and at any time during a course where a medical issue or injury arises affecting their participation. In this respect students must take responsibility for their own health and safety and not place themselves at risk of harm.

9.3 Attendees on certificated workplace courses must be reliable with the necessary disposition and communication skills to carry out the role of first aider at work.

9.4  For all certificated courses, attendees must be at least 16 years of age or over.

9.5  Attendees on workplace courses must be able to cope with physically demanding circumstances and stressful emergency situations at work.

9.6  Attendees who have completed workplace courses must be easily reachable in the event of a workplace emergency.

9.7  Attendees who are unable to meet any of the conditions listed above – 9.1 to 9.7 or who fail to meet the assessment criteria will not be awarded a certificate and will not be able to act as a first aider in the workplace.

9.8  It is the responsibility of organisations to select and appoint suitable persons to perform the role of first aider in the workplace.

10.  Re-certification courses:

10.1  It is the responsibility of organisations to ensure that attendees attending the course, hold proof of their existing first aid at work certificate.  This must be in date at the commencement of the re-classification course and must also be valid for the duration of the course.

10.2  If a student is awarded a re-certification and it becomes apparent at any time that the student’s first aid at work certificate was out of date prior to commencing the re-certification course, then their re-certification certificate will be invalid, even though they passed the re-certification course.

11.  Limitation of liability:

11.1  Except in respect of death or injury caused by the negligence of First Aid Bespoke Services Ltd, First Aid Bespoke Services Ltd shall not be liable by reason of any representation (unless fraudulent) or implied warranty, condition, or other term, or any duty at common law, or under these Terms and Conditions, for any loss of profit, or any indirect special or consequential loss, costs, expenses or other claim for compensation.

11.2  First Aid Bespoke Ltd’s entire liability to the customer under or in connection with the contract and the provision of services shall not exceed the sum of twice the price paid by the customer for that service.

12.  Data protection:

12.1  First Aid Bespoke Services Ltd will not share the personal data of the organisation’s attendees with any third party, individual or other organisation, excepting the awarding body for the purposes of certification and administration of records that pertain to the qualification or qualifications awarded to attendees.

12.2  Customers will give to First Aid Bespoke Services Ltd the name of the organisation booking the course, the organisation’s address, the name of the person booking the course, first name and surname of attendees and the organisation’s email address of each attendee.

12.3  First Aid Bespoke Services Ltd will send the certificates awarded to successful attendees by first class post, to the person within the organisation who booked the course, for distribution to attendees via the organisation’s own administration system.

12.4  First Aid Bespoke Services Ltd take no responsibility for loss of certificates sent to organisations through any failings of the postal system.

12.5  First Aid Bespoke Services Ltd will take all reasonable steps to ensure the safety and security of personal data supplied by organisations to prevent unauthorised or unlawful processing.

12.6  All attendees’ personal data held by First Aid Bespoke Services Ltd relating to the group booking, will be destroyed when it is no longer required for the provision of services and course administration.

12.7  Contact details for organisations will not be passed on to any third party by First Aid Bespoke Services Ltd.

13.  Data Protection enquiries:

13.1  The customer can request details of the personal data held about the customer and group course attendees under the Data Protection Act 2018.  For this purpose the customer may email First Aid Bespoke Services Ltd. or call 07890 534536.

14.  Complaints:

14.1  If the customer has any complaint about the services provided by First Aid Bespoke Services Ltd the customer may email First Aid Bespoke Services Ltd. or call 07890 534536.  Steps will be taken to resolve any complaint as soon as possible.
